  1. Acceptance of Terms
     These Terms and Conditions (“Terms”) are a legal agreement between you (“you,” “your”) and Exeter Botanicals, LLC (“Exeter,” “we,” “us,” or “our”), governing your access to and use of www.exeterbotanicals.com (the “Site”), including any content, features, products, and services offered on or through the Site. By accessing or using the Site in any way—including browsing, registering an account, or placing an order—you agree to be bound by these Terms. If you do not accept these Terms in full, you must not access or use the Site.
  2. Eligibility
     The Site and our products are intended only for adults twenty-one (21) years of age or older. By using this Site or purchasing products, you represent and warrant that you are at least 21 years old. Exeter reserves the right to cancel any order or refuse service if this requirement is not met.
  3. Changes to Terms
     We may amend these Terms at any time in our sole discretion. All changes are effective immediately upon posting the updated Terms on the Site, and your continued use of the Site constitutes acceptance of those changes. We encourage you to review these Terms regularly.
  4. Account Registration
     To access certain features or place orders, you may be required to create an account. You agree to (a) provide accurate, current, and complete information during registration; (b) maintain and promptly update your account information; and (c) maintain the confidentiality of your account credentials. You are responsible for all activities under your account.
  5. Product Orders and Payment
     5.1 Ordering. When you place an order, you make an offer to purchase products under these Terms. We reserve the right to accept or reject any order in our sole discretion.

5.2 Pricing & Payment. All prices are as listed on the Site at the time of purchase and may include applicable taxes. Prices are subject to change without notice. We accept major credit cards (Visa, Mastercard, American Express, Discover) and approved third-party payment providers. You represent and warrant that you have the legal right to use any payment method you provide.

5.3 Confirmation. Upon acceptance of your order, we will send you an order confirmation email. Title and risk of loss for products pass to you upon our delivery to the carrier.

  1. Shipping, Returns & Cancellations
     6.1 Shipping. We ship to locations where our products are legal. Shipping charges and estimated delivery dates are displayed at checkout.

6.2 Cancellations & Changes. You may request order changes or cancellations within 12 hours of purchase by contacting support@exeterbotanicals.com. After that window, orders may not be modified.

6.3 Returns. We accept returns within 30 days of delivery. To initiate a return, email support@exeterbotanicals.com for instructions. Return shipping costs are the customer’s responsibility unless the return is due to our error.

  1. Product Use & Disclaimers
     7.1 No Medical Claims. Our products are not intended to diagnose, treat, cure, or prevent any disease. Statements about product benefits (e.g., “supports relaxation,” “promotes restful sleep”) are general wellness claims and have not been evaluated by the FDA.

7.2 Consult a Healthcare Professional. If you are pregnant, nursing, taking medication, or have a medical condition, consult a physician before using our products.

7.3 THC & Drug Testing. Some products may contain trace amounts of THC (up to 0.3% by dry weight). Use may result in a positive drug test. Do not operate heavy machinery or drive under the influence of any intoxicating substance.

  1. Intellectual Property
     All content on the Site—text, graphics, logos, images, video, and software—is the property of Exeter or its licensors and protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
  2. User Submissions
     By posting reviews, comments, or other materials (“User Content”), you grant Exeter a perpetual, royalty-free, worldwide license to use, reproduce, modify, and display such content. You warrant that you own or have the right to post your User Content and that it does not infringe any third-party rights.
  3. Prohibited Conduct
     You agree not to:
  • Use the Site for any unlawful purpose or in violation of these Terms.

  • Post or transmit any harmful, fraudulent, or infringing content.

  • Circumvent security features or interfere with the Site’s operation.

  1. Privacy
     Your use of the Site is also governed by our Privacy Policy, which is incorporated herein by reference.
  2. Disclaimers of Warranties
     THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  3. Limitation of Liability
     TO THE FULLEST EXTENT PERMITTED BY LAW, EXETER AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS.
  4. Indemnification
     You agree to indemnify and hold harmless Exeter, its officers, directors, employees, and agents from any claim or demand, including reasonable attorneys’ fees, arising out of your violation of these Terms or your use of the Site.
  5. Governing Law & Dispute Resolution
     These Terms and any disputes arising hereunder are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any legal action must be brought in the federal or state courts located in Los Angeles County, California.
  6. Force Majeure
     Exeter is not liable for delays or failures in performance due to events beyond its reasonable control, including natural disasters, acts of government, or telecommunications failures.
  7. Miscellaneous
  • Severability: If any provision is held invalid, the remainder remains in effect.

  • Waiver: Failure to enforce any right will not constitute a waiver of that right.

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Exeter regarding the Site.
